OFFICIAL CONTEST RULES & REGULATIONS

Scotiabank Scene+ On-Campus Contest (the “Contest”)
Official Rules & Regulations (the “Rules”)

By entering this Contest, you agree to abide by these Rules and the decisions of The Bank of Nova Scotia (“Scotiabank” or the “Sponsor”), which are final and binding. This Contest will be administered by Arm Marketing Inc. (“Administrator”).

1. WHO CAN ENTER

This contest is only open to students of eligible post-secondary institutions* who at the time of entry:

  1. Are enrolled and in good standing in a Participating School* (or are enrolled by September 1, 2023);
  2. Are residing in Canada;
  3. Are seventeen (17) years of age or older; and
  4. Are not employees of Scotiabank and its affiliates and its and their advertising and promotional agencies as well as their mandataries and the immediate family of such employees and individuals living in the same household with such employees. “Immediate family” is defined as parents, siblings, children or spouse.

Potential winners may be required to provide the Sponsor with proof that the potential winner meets all eligibility requirements, including proof of enrollment in a post-secondary institution, residency status and any other documents required by Sponsor.

2. CONTEST PERIOD

The Contest runs from August 1st, 2023 at 12:00:01 am ET to September 30th, 2023 at 11:59:59 pm ET (the “Contest Period”).

3. HOW TO ENTER

NO PURCHASE OR ACCOUNT OPENING NECESSARY TO ENTER. VOID WHERE PROHIBITED.

  1. Registration Entry: To obtain one (1) entry into the Contest, during the Contest Period visit https://arm8.scotiabank.com and complete all registration fields (First Name, Last Name, Email Address, Phone Number, Date of Birth, Domestic or International Student Status, Post-secondary institution) and agree to these Rules. Limit of one (1) entry via this method.
    Advisor Meeting Bonus Entries: To obtain an additional two (2) bonus entries into the Contest, complete the registration form in Step 1 and book and attend an appointment with a Scotia Advisor during the Contest Period. To obtain your bonus entries, you must also register your appointment here. Limit of two (2) bonus entries via this method.
  2. Account Opening Bonus Entries: New and existing customers* who complete the registration form in Step 1 and successfully open a Student Banking Advantage Plan during the Contest Period can earn two (2) additional bonus entries into the Contest via this method. If you have opened your Student Banking Advantage Plan during the Contest Period, in order to obtain your bonus entries you must also register your new account details here. Limit of two (2) bonus entries via this method.

    *If you are an existing customer who already has the Student Banking Advantage Plan at the time of entry, provided you have registered for the Contest as set out in Step 1 above you will receive two (2) bonus entries regardless of the number of subsequent accounts opened, up to a maximum total of two (2) bonus entries via this method. To be eligible, existing and new account(s) must be open and remain in good standing (not be in default) during the Contest Period and up until the time of winner selection.

Maximum of up to five (5) entries per person. All entries become the property of Scotiabank and none will be acknowledged or returned. No responsibility is assumed by Scotiabank for any lost, late, damaged, destroyed, misidentified, illegible or misdirected entries or for any other such problems occurring in connection with participation in this Contest. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of computer programs and/or other automated devices to enter the Contest is prohibited. Any costs or expenses incurred by entrants in participating in the Contest including data rates if entrant enters the Contest via a mobile device are the responsibility of entrants. Normal internet access and device usage charges imposed by your online service provider will apply.

4. PRIZES

There are a total of thirty-one (31) prizes available each consisting of 100,000 Scene+ points (each a “Prize”). Approximate retail value of each Prize is $1000 CAD. The total approximate retail value of all Prizes is $31,000 CAD. Prizes will be allocated one (1) Prize per Participating School listed in Section 1.

Except at the discretion of Sponsor, Prizes are non-transferable and must be accepted as awarded; no cash substitutes. Sponsor reserves the right to substitute the Prize in whole or in part if all or any of the components of the Prize are unavailable with another prize of equal or greater approximate value. In the event that the winner is unable to redeem any or all of the Prize, due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided. Any costs or expenses incurred by winners in claiming or using their Prizes will be the responsibility of the winners.

5. PRIZE DRAW

A random draw will be conducted on or about October 18th, 2023 from all eligible entries received per Participating School received during the Contest Period. There will be one (1) entry from each Participating School randomly chosen (total of 31 entries) to be eligible to win a Prize. The odds of an entry being drawn depend on the total number of eligible entries received per Participating School during the Contest Period and the number of entries an entrant has been awarded. Limit of one (1) Prize per entrant regardless of the number of entries received.

By accepting the Prize, the winner (or in the case of a minor, his/her parent or legal guardian) consents to the use by Sponsor of his/her name, address (city and province), photo, image, likeness, biographical information, voice and/or any statements made by the winner regarding the Contest or Sponsor for promotional, advertising, marketing, publicity and commercial purposes in any and all media now or hereafter devised, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law.

Should a selected entrant fail to meet any of these Rules in Sponsor’s sole discretion, or a selected entrant cannot be reached or a prize notification is returned as undeliverable, entrant will be disqualified. A new random draw will be conducted from amongst all remaining eligible Entries in accordance with these Rules in order to select another potential Prize winner, who will be subject to the same conditions and could be disqualified in the same manner.

6. SELECTION OF WINNERS

Selected entrants will be notified by November 15th, 2023 by telephone or email using the phone number or email address associated with the entrant and contacted by a Sponsor representative and given instructions on how to claim the Prize.

In order to be declared the Prize winner and receive a Prize, in addition to complying with the terms and conditions of these Rules, the selected entrant must:

  1. be enrolled and in good standing in a Participating School at the time of Prize award;
  2. be residing in Canada at the time of Prize award;
  3. respond to the notification from Sponsor within forty-eight (48) hours and provide any additional information requested by Sponsor to confirm eligibility and to arrange the award of the Prize;
  4. correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by mail, email or phone, as Sponsor determines;
  5. if not a Scene+ member, sign-up for a free Scene+ membership;
  6. sign a release form (or in the case of a minor, his/her parent or legal guardian must sign a release form) confirming acceptance of the Prize as awarded and releasing Sponsor and its affiliates and the Administrator from any liability relating to the Prize and return it to Sponsor within seven (7) days from the date of receipt; and
  7. claim the prize at the mutually agreeable time determined in (c).

Should a selected entrant fail to meet any of these Rules in Sponsor’s sole discretion, cannot be reached, or fails to correctly answer the skill testing question, or if a prize notification is returned as undeliverable, the selected entrant will be disqualified. In that case, a new random draw will be conducted from amongst all remaining eligible entries for the applicable Participating School in accordance with these Rules in order to select another potential Prize winner, who will be subject to the same conditions and could be disqualified in the same manner.

By accepting the Prize, the winner consents to the use by Sponsor of his/her name, address (city and province), photo, image, likeness, biographical information, voice and/or any statements made by the winner regarding the Contest or Sponsor for promotional, advertising, marketing, publicity and commercial purposes in any and all media now or hereafter devised, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law.

7. GENERAL RULES

By entering this Contest, entrants accept and agree to be bound by these Rules, including all eligibility requirements and the decisions of the Sponsor and the independent judging organization, if any, which are final and binding without right of appeal on all matters relating to this Contest. Sponsor reserves the right to disqualify all entrants who fail to comply with these Rules or who make any misrepresentation relating to the Contest, drawing and redemption of any Prize.

The Sponsor shall not be responsible for any failure of email during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person’s computer, or property related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, at its sole discretion (subject only to applicable laws, including without limitation, any laws or regulations under the Régie des alcools, des courses et des jeux (the “Regie”), to cancel, suspend, extend or modify this Contest without notice, obligation or liability if in the Sponsors’ opinion there is any suspected or actual evidence of tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention, force majeure or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Contest, or for any other reason in Sponsor’s sole discretion. In such case, Sponsor may select the winner(s) from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way, or otherwise not in compliance with these Rules.

The Sponsor shall not be responsible in any way for the use of or bear any liability whatsoever in any way attributable to, the Prize awarded in this Contest or the events forming part of this Contest, including but not limited to typographical or other errors in the offer or administration of this Contest, these Rules, the selection and announcement of winners or the distribution of the Prize. The Sponsor and its affiliates, and its and their officers, directors, partners, partnerships, principals, representatives, agents, licensees, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning the Prize, (ii) disclaim any implied warranty or condition, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance, use or misuse of the Prize, travel related thereto or otherwise from participation in this Contest.

In the event of any discrepancy or inconsistency between the terms of these Rules and the terms or statements contained in any short-form Contest rules, advertising materials and/or the French version of these Official Rules, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by applicable law.

This Contest is subject to all applicable federal, provincial, and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

8. PRIVACY

The Sponsor is committed to respecting the privacy rights of entrants. Any personal information collected will be handled in strict accordance with The Scotiabank Privacy Agreement and all applicable privacy legislation. The Sponsor will not sell any personal information collected for this Contest to any third parties. Except as otherwise set forth herein with respect to the Prize winner, any personal information collected for this Contest shall be collected, used and disclosed by the Sponsor solely for the purpose of managing and administering this Contest. By entering this Contest, the entrant hereby consents to the Sponsor's collection, use and disclosure of the entrant's personal information in order to manage and administer this Contest's personal information in order to manage and administer this Contest.

9. WINNER NAMES

To obtain the names of the Prize winners, available after December 15th, mail a self-addressed stamped envelope by November 30th to: Arm Marketing Inc located at 160 Tycos Dr, Suite 2217, Toronto, Ontario, M6B 1W8.

10. FOR QUEBEC RESIDENTS

Any litigation respecting the conduct or organization of this Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

 

SHORT FORM RULES

NO PURCHASE OR ACCOUNT OPENING NECESSARY. Contest runs from August 1st, 2023 at 12:00:01 (ET) to September 30th, 2023 at 11:59:59pm (ET). Open to Canadian residents 17 years of age or older who are enrolled in an eligible post-secondary institution in ON, BC and QC as of September 1st, 2023. Thirty-one (31) winners (one from each eligible post-secondary institution) will each receive 100,000 Scene+ points (approximate retail value $1000). Odds of winning will depend on total number of eligible entries received from each eligible post-secondary institution and the number of entries an entrant has been awarded.
